Terms of Service

These terms govern your use of Dibbs ("the App"), a Shopify application provided by Dibbs ("we", "our", "us"). By installing or using the App, you agree to these terms.

1. Service description

Dibbs is a preorder management app for Shopify stores. It allows merchants to enable preorder functionality on product variants, display preorder buttons on their storefront, manage quantity limits, schedule preorder windows, and track preorder analytics.

2. Account and access

• You must have an active Shopify store to use Dibbs
• You are responsible for maintaining the security of your Shopify account
• You must be at least 18 years old or the age of majority in your jurisdiction

3. Plans and billing

• Free plan: Manage preorders on up to 5 products at no cost
• Paid plan: Unlimited products, billed monthly through Shopify's billing system
• Paid plans include a free trial period. You can cancel at any time through the Shopify admin
• Charges are processed by Shopify and appear on your Shopify invoice

4. Your responsibilities

• You are responsible for the accuracy of your preorder messaging (ship dates, availability, pricing)
• You must comply with all applicable consumer protection laws regarding preorders in your jurisdiction
• You are responsible for fulfilling preorders placed through your store
• You must not use the App for any illegal or fraudulent purpose

5. Data and privacy

Our collection and use of data is governed by our Privacy Policy. By using the App, you consent to the data practices described therein.

6. Integrations

Dibbs offers integrations with third-party services (Klaviyo, Omnisend, Slack, Shopify Flow). These integrations are optional and governed by the respective third-party terms of service. We are not responsible for the availability or functionality of third-party services.

7. Intellectual property

The App, its design, code, and branding are the property of Dibbs. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Limitation of liability

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any lost sales, revenue, or profits arising from the use or inability to use the App
• We are not liable for any issues caused by theme incompatibility, Shopify platform changes, or third-party integrations
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

9. Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify merchants of planned downtime.

10. Termination

• You may uninstall the App at any time through your Shopify admin
• We may suspend or terminate your access if you violate these terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

11. Changes to terms

We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. Material changes will be communicated via the App or email.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
